About these terms
These terms apply to your use of this website and any purchase from ProudGround ("we", "us", "our"). By using the website or placing an order, you agree to them. Please read them alongside our Shipping, Returns and Privacy policies.
Orders and pricing
All prices are in Australian dollars and include GST where applicable. Placing an order is an offer to buy; a contract is formed when we confirm dispatch. We may decline or cancel an order, for example where a product is unavailable, a price or description contains an obvious error, or we suspect fraud. If we cancel, we will refund any amount paid.
Product images are for illustration. Packaging, labels and colours may differ slightly from those shown.
Products and health
Our products contain caffeine, including small amounts in decaffeinated coffee. Seek medical advice if you are pregnant, breastfeeding, sensitive to caffeine or have a health condition. Our coffee is roasted and packed in a facility that may also handle other products. If you have an allergy or dietary concern, contact us before ordering. Brew safely: hot liquids and equipment can cause burns.
Intellectual property
The ProudGround name, logo, brush wordmark, packaging, photography, written content, the founder story and all other material on this website are owned by or licensed to ProudGround and are protected by Australian and international intellectual property laws. You may not copy, reproduce, adapt, sell or use any of it, including for commercial, political or promotional purposes, without our prior written permission.
The personal and cultural story of our founder and his family is shared with respect. It must not be reproduced, adapted or used to imply endorsement, partnership or affiliation without written consent.
Acceptable use
You must not misuse the website, including by attempting to gain unauthorised access, interfering with its operation, scraping content, posting unlawful or offensive material, or impersonating ProudGround or its founder.
Reviews and content you send us
If you send us reviews, photos, comments or other content, you grant us a non-exclusive, royalty-free licence to use, reproduce and display it to promote ProudGround. You confirm you have the right to share it. We may remove any content at our discretion.
Endorsement and affiliation
References to our founder's background, including any sporting career, are personal history only. Unless expressly stated, ProudGround is not affiliated with, sponsored by or endorsed by any sporting club, league, employer or other organisation.
Liability
To the maximum extent permitted by law, and subject to the Australian Consumer Law, our liability for any loss arising from goods or services is limited, at our option, to replacing the goods, resupplying the services or refunding the price paid. We are not liable for indirect or consequential loss, or for delays or failures caused by events beyond our reasonable control, including carrier delays, supplier shortages, natural disasters and outages.
Nothing in this policy excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) that cannot lawfully be excluded.
Third party services
Payments, checkout and delivery are provided by third parties such as Shopify, payment processors and carriers, whose own terms also apply. Links to other websites are provided for convenience; we are not responsible for their content.
Changes and governing law
We may update these terms at any time by posting the new version here. Orders are governed by the terms in place when the order was placed. These terms are governed by the laws of New South Wales, Australia, and you submit to the non-exclusive jurisdiction of its courts.
